Terms Of Service

Welcome to Urban Service Hub (USH). By accessing or using our website or mobile application, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms govern your use of the USH platform, including all related tools, applications, and services provided by USH.

User Agreement

This User Agreement outlines the terms and conditions governing your use of the USH platform. By registering as a Client, PRO, or Vendor, you agree to adhere to these terms. This agreement is a legally binding contract between you and USH, and it sets forth your rights and obligations as a user of our services.

  Registration

You must register for an account with us (“Account”) to access and use our services. Registered users of our Services are “Users”, and unregistered users are “Site Visitors”

  Account Eligibility

You promise to use our Services for business purposes only. You also promise that you are eligible to enter into this Agreement, including because you are 18 years or older.

USH offers the Services for your business purposes only and not for personal or consumer use. By registering for an Account or by using our Services, you represent that you:

  • (a) Are doing business under your own name as a self-employed individual/sole proprietor
  • (b) Will use our Services for business purposes only;
  • (c) Will comply with any licensing, registration, or other requirements with respect to your business, or the business for which you are acting, and any offering or provision of Freelancer Services; and
  • (d) Are either a legal entity or an individual who is at least 18 years old (or the age of majority in your country if the age of majority is over 18), and that you can form legally binding contracts.

  Account Profile

You must provide accurate personal information when you sign up and you must update your account if your personal information changes. We can suspend or terminate your account if the information you give us is false, outdated, or incomplete. To register for an Account to use our Services, you must complete a User profile (“Profile”), which you consent to be shown to other Users. You agree to provide accurate and complete information on your Profile—and on all registration and other forms you access while using our Services or provide to us—and you agree to keep that information current. You agree not to provide any false or misleading information about your identity, or your business, the beneficial owner(s) of your business, your skills, or the services your business provides, and you agree to correct any information that is or becomes false or misleading. We reserve the right to suspend or terminate the Account, or access to our Services, of anyone who provides false, inaccurate information in creating or maintaining a Profile or an Account.

  Account Types

We offer three types of accounts (“Account Types”): Client, provider and Vendor. Once you register for an account, you promise to register for only one Account that requires a unique log in. Never share your Account password with anyone.

  identity and Verification

You will allow us to verify your identity. When you register for an Account and periodically thereaft er, your Account will be subject to verification, including but not limited to validation against third-party databases or the verification of one or more official government or legal documents that confirm your identity, and your ability to act on behalf of your business on USH. You authorize USH directly or through third parties, to make any inquiries necessary to validate your identity, and confirm your ownership of your business or email address, subject to applicable law. When requested, you must timely provide us with complete information about yourself and your business, which includes providing official government or legal documents, and cooperating with other reasonable requests we make to verify your identity. During verification some Account features may be temporarily limited but will be restored if verification is successfully completed.

  Usernames and Passwords

You will keep your username and password secret and will not share them, and you will not use anyone else's username and password. Each person who uses our Services must register for their own Account with a username and password. You are responsible for safeguarding and maintaining the confidentiality of your username and password, and agree not to share your username or password with anyone. You are responsible for safeguarding your username and password and for any use of our Services with your username and password. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your Account or any unauthorized access to your password. You further agree not to use the Account or log in with the username and password of another User.

  Relationship between Client and Freelancers

Users, not USH, are responsible for deciding whether to enter into agreements with a professional and for determining the price of the service being offered by the professional. USH is not responsible for and is not a party to any Service request being carried out outside Urban Service Hub and under no circumstances should any such act be carried out on the platform.

Terms of Use

Your use of the USH platform is subject to these Terms of Use. You agree not to misuse the platform or engage in prohibited activities, including but not limited to:

  • Bypassing the Platform
  • Engaging in Fraudulent Activities
  • Abuse of the Platform
  • Violating Applicable Laws or Regulations

  Bypassing the Platform

Bypassing the platform refers to any attempt by a professional (PRO) to contact customers directly for job arrangements, thereby circumventing the USH platform. This is strictly prohibited as it undermines the integrity and security of our marketplace. Any professional found engaging in such activities will face immediate and permanent suspension from the platform.

  Engaging in Fraudulent Activities

Fraudulent activities include any actions intended to deceive or defraud other users or the platform itself. This can involve false representation of skills, qualifications, or services, as well as any attempts to manipulate the payment system. Engaging in fraudulent activities is a serious violation and will result in immediate suspension and potential legal action.

  Abuse of the Platform

Abuse of the platform encompasses a range of behaviors that disrupt the normal functioning of the USH services or negatively impact other users. This includes spamming and posting inappropriate content, and any other actions that violate the community standards of USH. Such behavior will not be tolerated and will lead to account suspension or termination.

  Violating Applicable Laws or Regulations

All users of the USH platform are required to comply with applicable laws and regulations. This includes, but is not limited to, laws related to data protection and intellectual property. Violating these laws can result in legal consequences and will lead to the immediate suspension of the offending account.

Escrow Instruction and Payment Agreement

All payments for services must be processed through the USH platform to ensure transparency and security. Payments are held in escrow and released to the PRO upon successful completion of the service. Payments are processed within 7 working days aft er service completion. This ensures that both clients and professionals are protected throughout the transaction process

Freelancer Membership Agreement

PROs must undergo a vetting process and maintain an active subscription to provide services on the USH platform. This agreement outlines the expectations and responsibilities of PROs, including maintaining high standards of service delivery and adhering to platform guidelines.

Mark Use Guide

The use of USH trademarks and logos is subject to our Mark Use Guide. Unauthorized use of our trademarks and logos is strictly prohibited. This guide provides detailed instructions on how to properly use our branding materials.

USH Marks

The USH name and logo are trademarks of USH

USH-logo

The USH Marks are among our most valuable assets. In order to preserve and strengthen our identity, these Guidelines provide conditions of use and clear instructions on the proper use of the USH Marks.

Use of USH logo marks

You may not use an USH Logo Mark unless you have a written license, granted by USH, permitting you to use the USH Logo Mark. If you have not been granted such a license, then you must not use, copy, modify, distribute, or post the USH Logo Mark for any reason. If you have such a license from USH Logo Mark to use the USH Logo Mark, you must use the USH Logo Mark only as licensed and only in accordance with these Guidelines.

The USH Marks that are also logos are also referred to in these Guidelines as the “USH Logo Marks”.

Prohibited use of USH marks

Unless you have written permission from USH, you must never use any USH Mark:

  • On any letterhead, business card, or signature block;
  • As part of your business name or a domain name;
  • As part of a user ID, including on USH or social media;
  • In association with any third-party trademark in a manner that might create potential confusion as to the ownership of the USH Mark;
  • In any manner that suggests or could lead someone to believe you are acting on behalf of or in association with USH or that USH has endorsed or sponsored your product or services; or
  • Outside of your relationship with us, except as permitted by USH in writing

Even if you have permission to use the USH Logo Mark, you must never use any USH Logo Mark:

  • That has been reproduced from an unauthorized artwork;
  • That has been modified, including color specifications, position, and relative size of the letterings;
  • That has been modified to use negative or reverse “drop-out” reproduction;
  • Tightly confined in a band or bar; or
  • With other seals, logos, or other marks of other entities

Use of Copy-Righted works

You may not use screenshots of or videos of navigation of the Site (as defined in the Site Terms of Use) or other works copyrighted by USH without USH written permission. Rights to screenshots of user profiles, communications, and work products on USH may need to be obtained from the User. You may not use such screenshots anywhere for any purpose without written authorization. USH cannot grant you permission to use screenshots that include third-party content.

Proprietary Right Infringement Reporting Procedures

If you believe your proprietary rights have been infringed upon, please report the violation to our admin team immediately. We take intellectual property rights seriously and will take appropriate action to address any reported infringements.

What are Cookies?

Cookies can be recognized by the website that downloaded them, or by other websites that use the same cookies. First party cookies are cookies that belong to USH, or are placed on your device by USH. Third-party cookies are cookies that another party places on your browsing device through our Site.

USH Pro Services Terms

PROs must adhere to the USH Pro Services Terms, which outline the expectations and responsibilities of service providers on our platform. This includes maintaining professionalism, delivering high-quality services, and complying with all platform guidelines

Referral Program Terms and Conditions

Our Referral Program allows users to earn rewards by referring new clients and PROs to the platform. The terms and conditions of the program are detailed here, including eligibility requirements, reward structures, and any limitations. USH may withdraw, or suspend, or change the requirements or incentives of the Referral Program, and may change the requirements and incentives at any time.

Eligibility

Referrer: You must be a registered user with an active account on USH

Referee

To be an eligible referee, you must not have ever had a USH Account and you must be referred by a qualified referrer via their unique referral link.

Qualified Referrals

For a referral to be considered a qualified Referral, all of the following must occur:

  • As an eligible referrer, you should sign up, login and share your referral link via email.
  • The eligible referee registers for an USH Account using your unique referral link.
  • Once the eligible referee has been verified, the referrer gets rewarded.

Referral Rewards

Referrers: As a qualified referrer, you will earn Referral Rewards in the form of wallet credit. Once the conditions for the qualified referral have been met, USH will credit your wallet account.

Refund and Cancellation Policy

USH does not refund payments in case of service failure by the PRO. Instead, a replacement PRO will be provided to complete the service. In the case of a Service Request cancellation by the Client, a deposit refund can be performed by our Customer Support team into the clients USH wallet, subject to review and potential fees. Frequent refund requests may incur additional fees to prevent fraud and abuse.

Dispute Resolution

In case of disputes, users must follow the platforms dispute resolution process. Attempting to resolve disputes outside the platform is prohibited. Our dispute resolution process is designed to ensure fair and efficient handling of any conflicts that may arise between clients and professionals. The following outlines the steps involved in our dispute resolution process:

Initial Communication

  • Direct Resolution:Clients and PROs are encouraged to communicate directly to resolve any issues or misunderstandings. Clear and respectful communication can oft en resolve disputes without further intervention.
  • Documentation:Both parties should document all communications and attempts to resolve the issue. This documentation will be important if the dispute escalates.

Filing a Dispute

  • Initiating a Dispute:If direct communication does not resolve the issue, either party can file a dispute through the USH platform. To initiate a dispute, the complainant must provide a detailed description of the issue, including any relevant documentation and evidence.
  • Timeframe:Disputes must be filed within 14 days of the service completion date. Disputes filed aft er this period may not be considered.

Review by Customer Support

  • Acknowledgment:Upon receiving a dispute, the USH Customer Support team will acknowledge receipt and provide an estimated timeline for resolution.
  • Preliminary Review: The Customer Support team will conduct a preliminary review of the dispute, including reviewing the provided documentation and evidence. They may also request additional information from either party.

Meditation

  • Meditation Process:If the preliminary review indicates that mediation is appropriate, the Customer Support team will facilitate a mediation process. This involves a neutral mediator working with both parties to reach a mutually acceptable resolution
  • Confidentiality:All mediation discussions are confidential and aimed at finding a fair resolution without assigning blame.

Resolution and Decision

  • Resolution Agreement:If mediation is successful, both parties will sign a resolution agreement outlining the terms of the settlement. This agreement is binding and enforceable.
  • Decision by USHIf mediation is unsuccessful or not appropriate, the Customer Support team will make a final decision based on the evidence and documentation provided. This decision will be communicated to both parties in writing.

Implementation of Resolution

  • Action Steps:The resolution decision will include specific action steps that must be taken by either or both parties. This may include payment adjustments, service corrections, or other remedial actions.
  • ComplianceBoth parties are required to comply with the resolution decision. Failure to comply may result in account suspension or other penalties

Final Resolution

  • Closure:Once the dispute is resolved, the case will be closed, and both parties will receive a summary of the resolution. The resolution will be recorded in the USH system for future reference.

Continuous Improvement

  • Feedback:USH values feedback from users regarding the dispute resolution process. Feedback will be used to continuously improve our processes and ensure fairness and efficiency.

Prohibited Actions

Any professional found to be bypassing the platform by contacting customers directly for job arrangements will face immediate and permanent suspension from the platform. This is to ensure the integrity and security of our marketplace.

Reporting Violations

If you observe any violations of these guidelines, report them to the admin team immediately. Serious breaches, especially those involving attempts to circumvent the platform, will result in immediate and permanent ban from the platform.

Customer Data

Respect the confidentiality and privacy of customer information. Do not share any personal data of customers outside the platform. This is crucial to maintaining trust and compliance with data protection regulations.

Professional Data

Keep your professional information accurate and up to date. This ensures that clients have access to current and reliable information about the services you offer.

Subscription Fees

Ensure your subscription fee is paid and up to date to continue receiving job opportunities. Failure to maintain an active subscription may result in not being able to accept a job request.

Job Payments

All job payments must be processed through the platform to ensure transparency and security. Payments are processed within 7 days aft er the completion of service. This policy helps protect both clients and professionals by ensuring that payments are handled securely and efficiently.
